For a number of decades, Illinois law stipulated that a non-custodial parent would be required to pay a certain percentage of his or her income as child support. The percentage was determined by the number of children being supported. The child support calculation was relatively simple, but many saw the law as too narrow and unfair to the paying parent. Two-income households have largely become the norm, but the law based child support payments on just one party's income after a divorce.

Over the last few years, a number of changes have been made to the Illinois laws applicable to child support. While the law still requires the parent with less parenting time—no longer called the non-custodial parent—to pay child support, the calculation now takes the income of both parents into account. The amount of parenting time that each parent has may also be factored into the calculation.

The Illinois Department of Healthcare and Family Services (DHFS) has developed tables that determine the basic amount of support that a child can expect based on the combined income of both parents. The basic amount can be adjusted to account for shared parenting situations, health insurance costs, child care expenses, and extracurricular activities. The resulting amount is then divided between the parents based on their contributed income.
