DuPage County Lawyers Advise on Stalking, Electronic Monitoring, and Harassment During Divorce

Hinsdale lawyers for spousal stalking and spying

Family Law Attorneys Assist Victims of Domestic Abuse in Elmhurst, Oak Brook and Villa Park

If you are married to a spouse who is physically abusive—or who you fear might become abusive if and when you file for divorce—your first step should be to get to a place where you are safe. If you have children, be sure that they are protected as well.

At Wakenight & Associates, P.C., we understand that domestic abuse is not limited to acts of physical violence. You may also be the victim of abuse if your spouse is stalking you, monitoring you electronically, or harassing you, either in person or through electronic means. Our experienced lawyers can help you manage the avalanche of personal, emotional, psychological, parental, custodial, logistical, and legal considerations associated with divorcing a spouse who engages in such behavior. We will assist you in taking action so that you can protect yourself and your children.

Stalking, Cyberstalking, and Harassment

The Illinois Criminal Code defines stalking as knowingly engaging in behavior toward another person such that the other person fears for his or her safety or the safety of a third person or suffers other emotional distress. Harassment, by comparison, refers to communication or conduct beyond that which is necessary to accomplish a purpose that is reasonable under the circumstances, and it can be committed in person, by telephone, or through electronic means. When the victim is the perpetrator's spouse, stalking and harassment are considered forms of domestic violence.

Cyberstalking is a similar criminal offense, and it refers to behavior that has the same result but that is committed using electronic means, including cell phones, computers, and other mobile devices. A suspicious or angry spouse may use electronic devices to monitor his or her partner's whereabouts and behavior, especially following a divorce filing.

At Wakenight & Associates, P.C., we understand the stress, anxiety, and fear that comes with being stalked, harassed, cyberstalked, or electronically monitored. Our lawyers believe that you should be free to live your life without having to worry about what your soon-to-be ex-spouse might say or do. If you have been the victim of behaviors such as these, we will work with you in exploring your available options. In some cases, an order of protection might be helpful, while in others, you may need to involve the local police or county prosecutors. Our team can also help you develop a strategy for using social media and other online resources safely and responsibly during your divorce.
